1. ELIGIBILITY

If an order is canceled due to a pricing error, a full refund will be issued to the original payment method.

The IWANA name, the Iwana Specialty Coffee Roasters logo, the Iwana iguana character, and all related names, logos, product and service names, designs, and slogans are trademarks of FARO USA, LLC. You may not use these marks without our prior written permission.
You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, sell, or exploit any content from our website for any commercial purpose without our express written consent. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE WEBSITE WILL BE ACCURATE OR RELIABLE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IWANA SPECIALTY COFFEE ROASTERS, FARO USA, LLC, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, ANY PRODUCTS OR SERVICES PURCHASED THROUGH THE WEBSITE, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC PRODUCT(S) OR SERVICE(S) GIVING RISE TO THE CLAIM WITHIN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Iwana Specialty Coffee Roasters, FARO USA, LLC, and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorney’s fees) arising from your use of the website; your violation of these Terms; your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or any claim that your use of the website caused damage to a third party. This indemnification obligation shall survive the termination of these Terms and your use of the website.
12. FOOD AND BEVERAGE DISCLAIMER
Iwana Specialty Coffee Roasters produces and sells coffee products. While we follow strict quality control and food safety protocols in compliance with FDA regulations, please be aware of the following:
Our products contain caffeine, which may not be suitable for all individuals. Consult your healthcare provider if you have any concerns about caffeine consumption. Our products are roasted and packaged in a facility that may also process other food products. We cannot guarantee that our products are free from allergens including but not limited to nuts, soy, dairy, wheat, and eggs. Customers with known food allergies should review product information carefully and consult a healthcare professional before consuming our products. Product descriptions, tasting notes, and flavor profiles are provided for informational purposes and reflect our professional assessment. Individual taste experiences may vary. Iwana Specialty Coffee Roasters is not liable for any adverse reactions, allergic reactions, or health effects resulting from the consumption of our products.
13. DISPUTE RESOLUTION AND BINDING ARBITRATION
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the website, products, or services (“Dispute”), you and Iwana Specialty Coffee Roasters agree to first attempt to resolve the Dispute informally by contacting us at hello@iwanacoffee.com. We will make good faith efforts to resolve any Dispute within 30 days of receiving your written notice.
If the Dispute cannot be resolved informally within 30 days, you and Iwana Specialty Coffee Roasters agree that the Dispute shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring qualifying claims in small claims court in Clark County, Nevada, if the claim falls within the court’s jurisdictional limits.
Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. The arbitration will be conducted in Clark County, Nevada, unless both parties agree to a different location or to virtual proceedings. Each party shall bear its own costs associated with the arbitration, except that Iwana Specialty Coffee Roasters will pay all AAA filing and administration fees if required by the AAA Consumer Arbitration Rules.
Class Action Waiver: You and Iwana Specialty Coffee Roasters agree that any Dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both you and we waive any right to a jury trial. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, but all other provisions of these Terms shall remain in effect.
You may opt out of this arbitration provision by sending a written notice to hello@iwanacoffee.com within 30 days of your first use of iwanacoffee.com. Your notice must include your name, address, email address, and a clear statement that you wish to opt out of the arbitration provision.
14. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. To the extent any legal proceeding is not subject to the arbitration provision in Section 13, such proceeding shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction and venue of such courts.
15. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of any other provision, and all remaining provisions shall continue in full force and effect.
16. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and Iwana Specialty Coffee Roasters regarding your use of iwanacoffee.com and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and us regarding the website.
17. WAIVER
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Iwana Specialty Coffee Roasters.
